Again, to be fair, it isn’t just Obama. Last November, the electorate voted in effect to repudiate the previous eight years and seemed genuinely under the delusion that wars end when one side decides it’s all a bit of a bore and they’d rather the government spend the next eight years doing to health care and the economy what they were previously doing to jihadist camps in Waziristan.

Does the Constitution apply to foreign nationals, coming to the US as armed combatants, out of uniform? Methinks not. But then again, to the pinko mind, it's all in those alleged penumbras.

Yep, it's right there in codicil xii of the 4th Amendment.
"Impacts and other Affects of types Disparate are denied The Representatives of the People, or the Office of the President, of this United States, unto Citizens of good standing, or bad standing, or no standing, or Non-Citizens of good standing, or bad standing, or no standing, or varied Aliens of form Human or human, or of earthly beings, of Material however Dark or Light of Construction.
