Your buddies from Gitmo are gonna plead guilty to murder? Ah, mais non, mais non! Surely all these Binnie Boys (starting with KSM) are innocent. Just let them go -- to Nawlins, there is a nice little house right next door to Pepe, surely he'd love to have those innocent poor little souls persecuted by big bad W-Rove-Halliburton-Cheney next to his bosom.

(A) Burden of proof is a concept (from the US Constitution) that applies to US citizens, or legal visitors, etc. It does not apply to foreign, unlawful combatants, like KSM, who took arms against the US, without wearing the uniform of a State.
(B) The cases you cite are ancient (2006 or so). I said, I assume all the Binnie boyz now at Gitmo are guilty as hell, and again, someone detained at Gitmo. If your IQ were above room temperature, you would probably have realized that that refers to the present. So again, let me spell it out, slowly: Do you know of, yes or no, of someone detained right now at Gitmo by US forces who is not there for legitimate reasons?

In war thousands get caught in combat and, if not killed, become prisoners of war. This is not arrest, it is capture of the enemy. This is not Cloiseau stuttering after the cad, it is the capture of enemy combatants. And, just because you jizz yourself when ogling those enemy combatants you so love does not change what they are. When you have war can people not involved, or regretting having been involved, or playing the Good Soldier Schweik of IM, get caught up in it? Sure. Did our government try to sort out who was who? Sure. Did our government make grotesque mistakes in this sorting out? Sure, just witness the number of those let go who quicktime were off to kill or be killed in another front of Jihad, laughing at the rube Yankees who had been so easily deceived.
Of course you want them to go free, that very hard core that remains. If let go , many would return oh so very fast to the sacred duty of increasing the stock of Dead Ricains. And that's an ambition any corrupt piece of Versailles' cesspool can drink his champagne to.

And, no, there is no reason whatsoever to believe any of the Binnie boys at Gitmo is "innocent", except in your feverish imagination. Why would Uncle Sam waste his time with 2-bit punks? Those that could go, left a while ago (though, of course, many of those "innocents" who were let go, went right back at hacking heads, as is their wont). Those who are left are the hard core, such as KSM, the mastermind of the 9/11 attacks. But surely, he's "innocent" in your eyes.
