Eisentrager that foreign nationals held in a military prison on foreign soil (in that case, Germany) had no habeas rights. But, without overruling Eisentrager, Kennedy said the Guantánamo detainees are different from the German prisoners 58 years ago.
This Kennedy makes me sick to my stomach. To think Ronnie had to settle on such a pathetic guy, after the Senate (led by the other Kennedy) torpedoes the nomination of Bork, by far the best jurist of his generation! America would have been a much better country nowadays if Bork woulda been on the SC, as he should've.
Ronnie chose idiots for SCOTUS because he was one. He was emotionally attached to the correct ideals and values but, that doesn't provide for wisdom. Amnesty for 1.5 Million illegals ( which we know turned into 3 Million ) and his solemn promise our laws would be enforced from there on is merely another on the list of his screw-ups he handed us.
Thompson on the other hand has the founding father's complete and detailed intent and direction where he has instructed on us yet, we've proven ourselves incapable of providing for our own governance.
Ronnie also elevated Rehnquist to be Chief Justice, and put Scalia on the SC. But he also came up with O'Connor (hmmm...) and Kennedy (ouchhh!) -- all in all, a mixed record on this front. But remember, the Dems controlled both houses of Congress in those years (by big margins), so his room for maneuver was limited on who he could nominate. And, once again, his best choice (with all due respect to Scalia, who is a great guy) was Bork, and he was borked. A disgrace to this day.
