Well, JJ, if this is not "adhering to their enemies, giving them aid and comfort", I don't know what is. Eg, if during WWII, Hitler had fired Goebbels and hired an American as his propaganda chief, would that American have given aid and comfort to the Nazis, or would that have been just free speech, protected by the all-encompassing First Amendment?

By the way, the Brits do not have the "aid and comfort" clause (heck, they don't have a Constitution!), but I think they do have the concept of treason somewhere in their laws -- after all, they hanged Lord Haw Haw after WWII, didn't they?
At any rate, I'm coming to the point. Here is a report from the Times of London:

Getting back to Gadhan, here is another declaration he made, a couple of months ago. Since JJ would surely have missed it (while merrily chasing mountain goats),

Camp Pendleton is located just south of where Gadahn grew up in California.
Cool, huh? I mean, what the heck does this guy have to say in order to convince JJ that he is a traitor?? Gadhan is trying hard, but JJ's treason bar is set so high, that he may never reach it...
Of course he is committing treason, AI. But not when he said what you quoted in the original post. Making threats is not treason.
'Repent or go to hell' could be construed as a threat. It could mean 'or I will send you to hell.'

Of course, if the threats come from a drunken hobo, perched upon a lamppost, it ain't treason.
But what if they come from a man who already defected to the sworn enemy of the US, and from that position (and with all that organization behind, hellbent on maiming and destructing) he makes threats such as going "on a shooting spree at the Marines' housing facilities at Camp Pendleton"? Not covered by Article 3, huh?
